By tendering materials for shipment via LetterExpress International Cargo Inc. and The e-BIZ Centre Limited (referred now on as LETTEREXPRESS- e-BIZ C.L.), the shipper agrees by the terms and conditions stated here and to LETTEREXPRESS - e-BIZ C.L. CONDITIONS OF CARRIAGE incorporated into the contract to reference and which are available from or for inspection at any LETTEREXPRESS - e-BIZ C.L. office. No agent or employee of LETTEREXPRESS - e-BIZ C.L. or shipper may alter or modify these terms and conditions.
This LETTEREXPRESS - e-BIZ C.L. AIRBILL is NOT NEGOTIABLE and the shipper acknowledges that it has been prepared by the shipper, or by LETTEREXPRESS - e-BIZ C.L. on behalf of the shipper. The shipper warrant that is the owner of the goods transported hereunder or it is the authorized agent of the owner of the goods and that it hereby accepts LETTEREXPRESS - e-BIZ C.L. terms and conditions for itself and as agent for and on behalf of any other person having any interest in the shipment.
The shipper warrants that each article in the shipment is properly described on this AIRBILL and has not been declared by LETTEREXPRESS - e-BIZ C.L. to be unacceptable for transport and that the shipment is properly marked and addressed and packaged to ensure safe transportation with ordinary care in handling. The shipper hereby acknowledges that LETTEREXPRESS - e-BIZ C.L. may abandon and or release any item consigned by the shipper has undervalued for customs purposes or misdescribed hereon whether intentionally or otherwise, without incurring any liability whatsoever to the shipper and the shipper will save and defend indemnity and hold LETTEREXPRESS - e-BIZ C.L. harmless from all claims, damages, fines and expenses arising therefrom. The shipper shall be liable for all costs and expenses related to the shipment and for the cost incurred in either returning the shipment to the shipper or warehousing the shipment deposition.
LETTEREXPRESS - e-BIZ C.L. has the right but not the obligation to inspect any shipment including without limitation opening the shipment.
LETTEREXPRESS - e-BIZ C.L. shall have a lien on any goods shipped for all freight charges, customs duties, advances or other charges of any kind arising out of the transportation hereunder and may refuse to surrender possession of the goods until such charges are paid.
The liability of LETTEREXPRESS - e-BIZ C.L., is limited to the lesser of:
a) U.S. $100.00
b) The amount of loss or damage to a document actually sustained, or
c) The actual value of the documents of parcel as determined under Section 6 hereof without regard to its commercial utility or special value to the shipper.
a) The actual value (which term shall include any item of no commercial value transported hereunder) shall be ascertained by reference to this cost of preparation or replacement, reconstruction or reconstruction value at the time and the place of the shipment whichever is less.
b) The actual value of a parcel (which term shall include any item of commercial value transported hereunder) shall be learned by reference to its cost of repair or replacement, resale or fair market value at the time and place of the shipment whichever is less. In no event shall such value exceed the original cost of the article actually paid by the shipper plus 10%.
In no event LETTEREXPRESS - e-BIZ C.L. will be liable for any damages, including any incidental or consequential damages, expenses, lost savings or any other damages arising out of use of LETTEREXPRESS - e-BIZ C.L. services, however arising whether or not LETTEREXPRESS - e-BIZ C.L. had knowledge that such damages might be incurred.
LETTEREXPRESS - e-BIZ C.L. will exercise its best efforts to provide expeditious deliver in accordance with regular delivery schedules. Nevertheless, LETTEREXPRESS - e-BIZ C.L. will not, under any circumstances, be liable for delay in pickup, transportation or delivery of any shipment, regardless of the cause of such delay.
a) Any claims must be brought by the shipper and delivered in writing to the office of LETTEREXPRESS - e-BIZ C.L. at the nearest location provided that the shipment was ordered within 30 days of the date of such claim. No claim will be accepted by LETTEREXPRESS - e-BIZ C.L. be beyond this date.
b) No claim for loss or damage will be entered until all transportation charges have been paid. The amount of any claim may not be deducted from any transportation charges owned to LETTEREXPRESS - e-BIZ C.L.
These terms and conditions shall apply to and to the benefits of LETTEREXPRESS - e-BIZ C.L. and its authorized agent and affiliated companies and their offices, directors and employees.
